What Happens If You Get Caught with Cannabis Abroad?
Summer vacation is prime time for making bad decisions — and perhaps none will cost you more money than thinking that the laws surrounding cannabis from your home country apply everywhere else you go. Whether you’re dancing through festivals in Europe, or jetting off to somewhere farther away — the laws about how much THC is allowed in each country shift dramatically once you pass the border.
The big issue: THC doesn’t travel well
THC containing cannabis is prohibited in nearly every single country in the world. The difference is how seriously the consequences of getting caught are taken — and there is such great disparity between countries that it could mean a huge difference based on which country you are traveling to.
Bringing cannabis across an international border is a separate offense with greater penalties than simply possessing cannabis. And while you can travel between two countries where cannabis is essentially decriminalized — you commit an international smuggling offense the minute you bring it past customs.
Regardless of the quantity — there is no acceptable amount. Regardless of whether you had a medical justification for using cannabis — if you had permission from a doctor in the u.k., it doesn’t count anywhere else.
Country by country: just how bad could it be?
| Destination | Legality | Caught with cannabis — realistic outcome |
| Netherlands | Only tolerated in coffeeshops | You’ll probably get fined or cautioned. But, you aren’t supposed to transport it over international borders |
| Spain | Decriminalized (for personal use) | You’ll get a fine. Cannabis clubs are basically a gray area legally |
| Germany | Partially legalized (as of 2024) | Adults are allowed Up to 25 grams — as long as they comply with certain conditions |
| Dubai/u.a.e. | zero tolerance | Four + years jail time. Trace amounts can lead to prosecution. |
| Thailand | Recriminalized (in 2024) | Fines to jail time. Thailand’s new policy was an abrupt change that surprised many travelers who were visiting for their cannabis vacations. |
| United states | A federal crime. However, dependent upon what state you are in. | Federal property (such as airports and national parks) – irrespective of the state laws – you’ll receive a federal charge. |
| Japan | zero tolerance | Possession of marijuana can lead to five years in jail. |
| Portugal | Decriminalized | Small quantities of marijuana won’t lead to a criminal record. You’ll receive an administrative fine. |
Countries where one mistake will cost more than money
There are some jurisdictions that view cannabis so harshly that they shock westerners. The United Arab Emirates has a zero-tolerance policy toward marijuana, so severe that residual THC metabolites detected in urine samples (even though they were consumed weeks prior), have led to prosecutions.
You don’t have to be bringing anything with you. You simply have to have smoked/used it recently.
Both Japan and Singapore enforce similar policies. Singapore takes it one step further and executes people convicted of trafficking large quantities of marijuana.
These are not theoretical possibilities. There have been numerous cases of tourists being arrested and imprisoned due to these laws.
Another example is Thailand. In 2022, Thailand became the first Asian nation to decriminalize cannabis, creating hundreds of dispensaries and generating a large cannabis tourist trade.
By 2024, however, Thailand recriminalized the sale of recreational cannabis. This left many unsuspecting tourists trapped in a completely different set of laws than what they thought existed.
Will I have trouble using CBD products when traveling internationally?
Generally yes, but not always. International laws regarding CBD vary greatly:
- EU countries typically allow CBD products that contain less than .20-.30% THC.
- Both UAE and Japan consider CBD to be virtually indistinguishable from THC, therefore it should never be brought into those countries.
- although the u.s. Allows CBD derived from hemp at the federal level, airport security and varying state laws create complications.
- Australia requires prescriptions for any type of cannabinoid-based products.
Although most border control agencies cannot visually identify CBD vs THC oils — they are often identical in appearance and odor — the greatest risk associated with taking CBD oil on an airplane ride overseas, is that the border agent may assume that it contains THC — especially if a lab test shows even a minimal presence of THC in the product — including amounts that would be perfectly acceptable under u.k. Law.
What to expect if things go horribly wrong while you are overseas
Unfortunately, Consular services from the British Embassy are extremely limited. They can only notify family members of your detention, provide you a list of local lawyers who may help you, visit you while you are being held in custody — but they can not obtain your release, pay for legal fees, or influence the actions of another country’s judicial system.
Most travel insurance policies sold by companies based in the UK exclude coverage for incidents resulting from illegal drug use — therefore all costs associated with repatriation and medical expenses as well as hiring attorneys fall on either yourself or your family members.
In addition, convictions acquired overseas also follow many people home. Under bilateral agreements between some countries, conviction data is shared between them and their partner countries.
Travel smart and purchase discreetly
Borders don’t care about tTHC and neither do the consequences of bringing it past borders. The gap between a €50 fine in Lisbon and four years imprisonment in Dubai exists solely because of the country that you stand in at any given moment.
Know the laws before you travel, leave anything questionable behind, and don’t count on “i didn’t know” being accepted as a valid defense in foreign courts.
